Terms of Use

You are solely responsible for the photos, graphics, music, video and other content that you give MakStar for the creation of your MakStar. If you request that we purchase the license to photos, graphics, music, video and other content for your video you are responsible for following all terms of that license. You are solely responsible at your sole cost and expense for unlawfully using or distributing your MakStar without the appropriate licenses.

When you give us content you authorize and direct us to make such copies thereof as we deem necessary in order to facilitate the creation of and storage of your MakStar. You retain full ownership of all of your content and any intellectual property rights or other proprietary rights associated with your content. If you are not the creator of Image Content, then you must get permission from the creator of the Image Content or the copyright holder to use the Image Content in a MakStar. For example, professionally-taken photographs should not be used in a MakStar unless you have received permission from the photographer to do so. Furthermore, if you want to provide Image Content of someone other than yourself, you must get permission from the individuals portrayed in the Image Content before providing MakStar with the content. Do not provide us with any Content that is confidential or proprietary. We assume no liability with respect to the disclosure or use of confidential or proprietary information.

Musical Content that is not an original creation by you is also protected under copyright laws. Copying music without purchasing or obtaining the rights to the music is against the law. Prior to providing us with Musical Content, you must be sure that you have the permission to use such Musical Content in a MakStar.

If you are unsure whether you have the necessary rights to use specific Music Content, MakStar encourages you to choose Musical Content available through MakStar or we can help you purchase the rights to music through another source. You must agree to follow all licensing agreements that we provide you for the Music Content. You are responsible for obtaining the licensing agreement(s) from MakStar and for reading and following all terms of the licensing agreement(s).

You warrant that all content provided by you, either from your own computer or another website/server, is either created or owned by you, or you have the necessary licenses, rights and permissions to use the Image and/or Musical Content and grant MakStar the rights to Create your MakStar.

You hereby grant MakStar a royalty-free, perpetual license to use, copy, create, modify, and display your MakStar, Image Content, and Musical Content solely to the extent necessary for MakStar to provide you with our Services.

You may also agree to allow MakStar the right to display for promotional purposes your MakStar on the Internet. Upon your verbal or written agreement we will be at liberty to display your video on the Internet. If at anytime you would like us to remove your MakStar, we will do so within 10 business days of acknowledged receipt of your request. We are not responsible for failing to remove your MakStar Video if your request was not received by MakStar.
